THE GEMSNY SWEEPSTAKES

1. Official Rules

   This document contains the general official rules governing sweepstakes sponsored by GemsNY Corp. These rules are to be read in conjunction with other specific rules governing specific sweepstakes from time to time. GemsNY Corp. keeps complete discretion to amend or make additions to these rules without prejudice. The word 'Sponsor' used hereafter in this document refers to GemsNY Corp. The words entrants or participants used hereafter refer to the individuals participating in the sweepstakes. The term sweepstakes also refers to giveaways as announced from time to time and all the conditions mentioned in this document also govern giveaways sponsored by GemsNY Corp.

2. Legal Disclaimer

   By participating in the sweepstakes you agree unconditionally to the following:

   • You can not claim any right whatsoever to the prize under any circumstances.
   • Participating in the sweepstakes does not construe any sort of guarantee to win irrespective of winning probability.
   • Any claims, and causes of action arising out of or connected with these Sweepstakes, or the Prize awarded shall be resolved individually, without resort to any form of class action/suit. You relinquish your right to take any dispute arising out of any reason related to sweepstakes to any court of law whether in the United States or anywhere else.
   • Dispute, if any, shall be resolved with a mutual dialogue between the participant (not his/her representative) and an authorized person or entity acting on behalf of GemsNY Corp.
   • The decision of the Sponsor (GemsNY Corp.) shall be final and binding on all participants and the winner(s).
   • There are NO WARRANTIES expressed or implied made by the Sponsor and, additionally, no implied indemnities of any kind.
3. Eligibility
   • You must be a US citizen residing in the US or a legal resident of the US with a valid US address.
   • You must be above 18 years of age.
4. Requirements
   • NO PURCHASE IS NECESSARY TO PARTICIPATE.
   • You must follow us on Instagram, like our sweepstake posts, share our sweepstake posts, and post your comments thereon.
5. Sweepstakes Timings
   • The monthly sweepstakes shall begin at 11a.m. EST on the first day of every month and shall end at 11:59 p.m. EST on the last day of that month.
   • The timings and the duration of occasional sweepstakes shall be announced from time to time.
   • GemsNY Corp. reserves the right to change or amend the timings at its discretion.
6. Sweepstakes Awards and Value
   • GemsNY Corp. shall announce awards in the form of a gemstone or a complete piece of jewelry or a setting for a jewelry at its own discretion. The details of such an award shall be published on our website and/or our social media platforms.
   • The value of each award is usually $1,000 (USD One Thousand Only). However, it can be changed from time to time at the discretion of GemsNY Corp.
   • The value of the awards shall be published in the announcement of the sweepstakes.
   • The value of the award of any and all sweepstakes offered by GemsNY Corp. is not open to any third-party evaluation. GemsNY Corp. sets the value of its sweepstakes according to its own evaluation of the item being offered under the sweepstakes.
7. Shipment & Transferability
   • The specifics of the delivery of the prize shall be solely determined by the Sponsor.
   • It is the responsibility of participants to furnish the correct address. If the address is incorrect, the Sponsor can't be held responsible for non-delivery or any other delivery related issue.
   • The prize is not transferable or assignable.
   • No substitution or transfer of the prize is permitted, except that the Sponsor may substitute a prize component of equal value for any reason.
   • Prize is awarded "as is-where-is" with no representation, warranty or guarantee, either expressed or implied by the Sponsor.
8. Announcement of Winner
   • Winner shall be selected at random by a draw based on the comments, likes and shares of our Instagram posts during the sweepstakes period.
   • The announcement of the winner shall be made in the week following the last day of the sweepstakes.
   • The name of the winner shall be publicly posted on our Sweepstake page.
   • The winner shall be contacted via email and/or DM in order to complete formalities related to delivery of the prize.
9. Date Collection / Privacy

   The Sponsor collects personal information from Entrants when they enter the Sweepstakes for use in administration of the Sweepstakes. The information collected is subject to the Privacy Policy located at https://www.gemsny.com/policies/privacy. By participating in the Sweepstakes, Entrants hereby agree to the Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy. You can withdraw your consent along with your entry from the sweepstakes at any time by contacting privacy@gemsny.com .

10. Other Important Guidelines

    All Entrants and any winners, as a condition of entry into the Sweepstakes, agree to release Sponsor, its directors, officers, parents (if any), subsidiaries and affiliated companies, contractors, agents, representatives, suppliers, printers, application developers, advertising, promotional or judging agencies (the "Released Parties"), from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with accessing the Sweepstakes page; submitting an entry or otherwise participating in any aspect of the sweepstakes; the receipt, ownership or use of any prize awarded; preparing for, participating in any Sweepstakes-related or prize-related activity, or any typographical or other error in these Official Rules or the announcement of offering of any prize. The Released Parties are further not liable for damage to a participant or user's computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an participant's participation in the Sweepstakes or downloading of information in connection with the Sweepstakes. Sponsor reserves the right to modify or cancel the Sweepstakes in the event that any portion of any website used to administer any aspect of the Sweepstakes becomes technically corrupted.
